Revenge pornography is a crime and refers to posting nude or illicit pictures or videos without the subject’s consent. With the rise of modern day technology, including smartphones equipped with cameras and video recording devices, posing for nude pics is very common. In some cases of revenge porn, the victim may have not even been aware that the images were taken. Regardless of if the pictures or videos were taken knowingly or secretly, the person posting them is doing so without permission. Most victims feel violated, embarrassed and angry and may not want to get help.

If you have been the victim of revenge porn, or if you have been charged with the crime of sexual cyberharassment, please call us at 866-608-5529 or contact us online. We can evaluate your case and determine what we can do to help you.

What is Revenge Porn?

Under Florida Statute 784.049(3), the crime of revenge porn, also known as sexual cyberharassment, is committed when someone posts or publishes a nude or semi-nude image or video of another person without their consent. This is accompanied by publishing personal identifying information of the person to a website without the person’s consent for no other purpose than to cause emotional harm or distress to the person in the pictures/videos.

What Are The Penalties for Sexual Cyberharassment in Florida?

First Offense:

If this is your first offense, the crime of sexual cyberharassment is classified as a first-degree misdemeanor in Florida and punishable by up to one year in jail, one year of probation, and $1,000 in fines.

Second Offense:

If this is your second offense, the crime of sexual cyberharassment is classified as a third-degree felony in Florida and punishable by up to five years in prison, five years of probation, $5,000 in fines, and 60 days vehicle impoundment or immobilization.

A second offense of sexual cyberharassment is ranked as a Level 1 offense under Florida’s Criminal Punishment Code, which means a judge is required to sentence a person convicted of this crime to a minimum sentence of 10 days in jail, but may also sentence the person up to the statutory maximum of five years in prison.

Are You The Victim of Revenge Porn?

If you are the victim of revenge porn, we cannot stress enough the importance of speaking up. People who post your intimate photos may be doing so for money or just to simply humiliate you. This could be the aftermath of a relationship gone wrong. After the images/videos are posted, they may spread to multiple sites. It can be extremely overwhelming to try and have these images removed.

Speaking up about a bad situation is the only way to take control. The person who posted the photos/videos may not think you will fight back. However, it is in your best interests to learn about your options for holding the person responsible for this online mayhem accountable.
