Attempted Sexual Battery

Ocala Man Accused of Trying to Rape 10-Year-Old Girl

The Ocala Police Department arrested a 38-year-old man Monday on capital sexual battery charges.

The Ocala suspect is accused of attempting to have sex with a 10-year-old girl, according to an OPD report.

An investigator with the Department of Children and Families contacted the OPD after receiving a call about the case on Aug. 2. The 10-year-old girl allegedly told officers she was asleep in her mother’s room on her mother’s bed when she felt someone touching her buttocks, according to the report. The girl claims the man rolled on top of her, covered her mouth and forced her hand to touch his private area.

The girl alleges the man tried to have sex with her, but she was able to push him off and report the assault to her relatives.

The girl was taken to Kimberly’s Center for Child Protection, where she told the people there a similar story.

On Monday, officers located the man and took him to the OPD for an interview. He denied having any sexual contact with the girl.

The man was arrested and transported to the Marion County Jail.

When facing an allegation pertaining to sexual misconduct of any kind, it is very important to consult a criminal defense attorney immediately. Acting fast is critical in these types of cases. Taking a “wait and see” approach or voluntarily answering any police questions without the presence of a lawyer will not end well. Police are not on your side when it comes to hearing your version of what happened. Submitting to questioning by the police without the benefit of an attorney can have disastrous consequences on the outcome of your sex crimes case.

Penalties for a sex crimes conviction can range from lengthy state prison sentences to having to register as a sex offender or sexual predator for the rest of your life. A Florida Sex Crimes Defense Lawyer at Whittel & Melton can help you with your defense after you have been accused of capital sexual battery or any similar sex crimes charge.
