A former Volusia County elementary teacher was arrested Jan. 4 at her Palm Coast, FL home for numerous sex crimes involving an Archdale, North Carolina student.
The 28-year-old ex-third- and fourth-grade teacher resigned from her position Jan. 5 after five years of service in the district.
She faces charges of indecent liberties with a child, soliciting a child by computer, disseminating obscene material to a minor under 16 and preparing obscene images.
Archdale police and deputies in Flagler County, FL worked together in the teacher’s investigation and arrest.
After appearing in front of a judge, her bond was set at $10,000.
Florida law prohibits sending sexually explicit or obscene material to minors that depicts nudity or displays sexual conduct or sexual excitement. This crime is a third-degree felony carrying consequences of up to five years behind bars. Additionally, the State can charge multiple counts of this crime for each image transmitted. Meaning, if there was a substantial amount of material that can be deemed “obscene,” you could be facing numerous charges for the same crime that could result in consecutive sentences.
Sex crimes cases, especially those involving juveniles, tend to be treated differently than other criminal matters. A conviction usually carries long sentences and life-long registration as a sexual offender or predator. Most people, included judges and juries, tend to side with the child’s story and believe the worst about those accused of child sex offenses. However, at Whittel & Melton, our attorneys understand that not all people accused of committing sex crimes are guilty. We believe in helping those facing harsh criminal consequences and providing them with solid representation and a strong defense.
