A 33-year-old man was arrested last Wednesday after the Florida Department of Law Enforcement allegedly found more than 500 child pornography files on his Gateway laptop.

The man supposedly told investigators that his teenage children must have downloaded the pornographic files depicting children involved in graphic sexual acts – including infants.

According to reports, the man and his wife insist that their 13- and 15-year-old children must have downloaded the files.

Authorities claim that in an initial computer forensic review, the man’s profile was allegedly in use for multiple personal programs while the files were being downloaded.

The man was jailed in Orange County on multiple child pornography charges.

Penalties for child pornography are often very harsh. Most child porn charges are felonies and if you are convicted of any type of child porn charges, penalties can include fines, county jail or state prison time, and registration as a sex offender, which is a label that can hang over your head for the rest of your life. In child porn cases, law enforcement agents usually search for any shred of evidence they can find to use against you. It is not unlikely for your e-mails, instant messages and other online activity to be scrutinized. Your computer will undoubtedly be exposed to strict review.

Child pornography is classified as any material, printed or digital, that shows minors engaged in sexual activities. Child porn can display children under the age of 18 partaking in:

  • Intercourse, oral sex, anal sex or any other type of act deemed lewd and lascivious in nature
  • Penetration of the vagina or rectum with an object
  • Masturbation
  • Sadomasochistic abuse
  • Display of genitalia region
  • Defecation and/or urination

Even if you have been accused of possessing child pornography, it does not mean you are guilty. Sometimes a simple mistake, like someone else downloading the material can be to blame. In fact, if someone else downloaded child porn onto your computer without your knowledge, you could possibly be cleared of any charges against you. Sometimes a computer virus can be the culprit behind an illegal download. Whether images were found on your computer that you had no knowledge of or you simply had a momentary lapse in judgment, the Florida Child Pornography Defense Attorneys at Whittel & Melton can provide you with the legal help you need.
