Ocala, Florida Molestation Defense Attorney :: 30-Year-Old Man Arrested for Molesting a 10-Year-Old Girl
A 30-year-old Marion County, Florida man was arrested Wednesday and charged with capital sexual battery and lewd and lascivious molestation for his alleged involvement with a 10-year-old girl.
The girl’s mother told detectives that the man had touched her daughter inappropriately. The girl was interviewed and supposedly told detectives that the man had molested her for about two months.
The man denied the allegations and was transported to the Marion County Jail.
It is important to note that capital sexual battery is a capital felony and carries a mandatory life sentence. Sexual battery is Florida’s term for rape and consent cannot be a defense for this charge unless the victim is over the age of 12. If the offender is in a guardian or custodial parent position and the victim is under the age of 18, consent cannot be used as a defense either.
Many times false accusations of sexual battery can ruin innocent people’s lives and affect their lives on all fronts. It is not uncommon for false accusations to be made for the sake of getting attention, jealousy or even revenge. Vindictive co-workers, family members, friends or even ex-lovers may make life ruining accusations to sort out personal feuds. To clear your name there is necessary evidence that needs to be gathered as well as any witnesses. If no evidence can be collected, then medical proof may be the only way to prove your innocence. This can be gathered through polygraph tests, DNA tests and psychological tests and evaluations which are all admissible in Florida courts.
