Ocala Man Charged with Capital Sexual Battery

A 38-year-old man accused of having sex with a young girl was charged with capital sexual battery on Tuesday.

The man remained in the Marion County Jail on Wednesday, with no bond.

Detectives claim that they were told in late April that the man allegedly had sex with a then 11-year-old girl in late 2013 and early 2014.

The girl apparently told officials at Kimberly’s Center for Child Protection that the man came to her home and gave her candy. She said he jumped on her to prevent her from screaming and took her to a bedroom where he fondled her and had sex with her. She told police that he has had sex with her numerous times, and warned her not to tell anyone.

Court records indicate that the man has been convicted of several criminal offenses, including petit theft and soliciting another to commit prostitution.

When a sexual battery crime has certain elements, it can be classified as “capital sexual battery” due to the harsh punishment that will be imposed by the court if convicted. This is a capital felony offense that occurs when an individual 18 years or older has sexually battered another person who is 12 years or younger. This felony carries consequences of life in prison.
