Prostitution Laws and Penalties in Florida

Under Title XLVI, Chapter 796 "Prostitution" of the Florida Statutes, it is illegal to:

  • Offer or agree to secure another person for the purpose of prostitution
  • Transport or take a person somewhere for the purpose of prostitution
  • Own or rent property for the purpose of prostitution
  • Solicit or persuade another to engage in prostitution
  • To offer sexual acts in exchange for money
  • To agree to accept money in exchange for sexual acts
  • To commit or engage in prostitution
  • To participate in any way or to aid or abet another in any of the above acts

A first offense is punishable by up to 60 days in county jail; a second offense by up to 12 months in county jail; and a third offense is punishable by up to 5 years in state prison. Procuring a minor for the purpose of prostitution is punishable by up to 15 years in state prison.

Additionally, sex trafficking is punishable by up to 15 years in state prison and sex trafficking involving minors under the age of 14 is punishable by up to 30 years in state prison.
