Florida Law Regarding Indecent Exposure
Title XLVI, Chapter 800.03 of the Florida Statutes state that it is illegal for a person to expose his or her sexual organs in a public place or on the private property of another person, in a lewd or indecent manner. It is also illegal to be naked in public, unless this is in a place meant for that purpose (such as guests at a nude beach or a spa, or an employee at a gentleman's club). Performing sexual acts in public is also unlawful, but breastfeeding in public is not a violation of the law.
Exposure of sexual organs in public is a 1st Degree Misdemeanor under this Statute and may be penalized by up to one year in county jail, fines, probation and registration as a sex offender. If you are accused of exposing your sex organs near a school or playground or to a child under the age of 16, you may face felony charges. If physical contact is made, the charges may escalate to sexual assault.
If you would like to have a chance of avoiding these penalties, contact Gainesville sex crimes defense attorney Robert G. Whittel. We offer a free case evaluation to determine what can be done about your particular charges. Even if your case seems helpless; even if the prosecution has physical evidence and witness testimony against you, a skilled defense lawyer may still be able to contest the charges, secure lessened sentencing and even secure a verdict in your favor.
